These General Terms and Conditions (hereinafter the “GTC”) govern the use of the online platform Lystero (hereinafter the “Platform” or “Lystero”), operated by Genie IT Solution, Switzerland.
The following definitions apply:
By registering or using the Platform, the User accepts these GTC. Deviating terms of the User are not recognised unless Lystero expressly agrees to them in writing.
Lystero is an online marketplace that enables Users to create listings, offer and search for goods and services, and get in touch with one another.
The purchase or service contract is concluded exclusively between Buyer and Seller. Lystero is not a party to this contract and owes neither the delivery of the goods nor their characteristics.
This must be distinguished from the “Safe Pay” service provided by Lystero itself (section 7): here Lystero acts towards Users as the provider of payment processing. To that extent Lystero is a party to the Safe Pay contract, but not to the underlying purchase contract.
Certain features require registration. The User provides truthful and complete information and keeps it up to date. Use is permitted to natural persons aged 18 and over and to legal entities with legal capacity.
The User keeps their login credentials confidential and is liable for activities under their account to the extent of their fault. Any suspicion of misuse must be reported to Lystero without delay.
Lystero may block or delete accounts where there is justified suspicion of breaches of these GTC or applicable law. Transactions already running via Safe Pay are settled in accordance with sections 7 and 8.
The Seller is solely responsible for the content and lawfulness of their listings. The Seller warrants that their information is truthful, that they are entitled to sell, and that no third-party rights are infringed.
The following are not permitted in particular:
When selling via Safe Pay, the Seller undertakes to deliver the goods or render the service promptly, completely and in conformity with the contract after the transaction is released, to retain proof of dispatch, and to provide valid payout details (IBAN).
Lystero may block or remove listings that breach these GTC or applicable law.
A listing constitutes a non-binding invitation to submit an offer, unless expressly stated otherwise. The contract between Buyer and Seller is concluded once the parties agree on goods and price, or once the Buyer completes the Safe Pay purchase and payment is successfully authorised.
Users settle their contract on their own responsibility. Lystero recommends handling transactions via Safe Pay in order to protect both sides.
The following are prohibited in particular:
Safe Pay is an optional service through which Lystero processes the payment between Buyer and Seller in order to protect both sides. The technical payment processing is carried out via the external payment service provider Stripe (Stripe Payments Europe Ltd.). The terms of Stripe additionally apply.
The process:
Lystero receives the funds solely for forwarding within the respective transaction and grants no interest thereon. Lystero is not a bank and does not conduct deposit-taking business.
Payout requires a valid bank account in the Seller's name and the fulfilment of any identification and due-diligence obligations. Lystero may withhold payouts as long as there is justified suspicion of fraud, chargeback or an open dispute.
If the Buyer does not receive the goods or they deviate materially from the description, the Buyer may open a dispute via the Platform before release. The amount remains held during a dispute.
Lystero reviews disputes at its reasonable discretion based on the evidence submitted (e.g. proof of dispatch and of communication) and may refund the amount to the Buyer or release it to the Seller. This review does not replace a judicial assessment; the Users' civil-law claims against one another remain unaffected.
Refunds are generally made to the payment method originally used. In the event of chargebacks or payment fraud, Lystero reserves the right to withhold affected amounts and to charge the resulting costs to the User who caused them.
Basic use of the Platform is free of charge. Fees may apply for certain services (e.g. promotions, premium features) and, where applicable, for the use of Safe Pay. The applicable prices and fees are disclosed transparently before conclusion.
Unless stated otherwise, all prices include statutory value added tax. Payments for chargeable services are due in advance.
Lystero is not liable for the accuracy, completeness or lawfulness of user-generated content, nor for the performance of the contracts concluded between Buyer and Seller (in particular delivery, defects, characteristics of the goods).
For the Safe Pay service provided by Lystero itself, Lystero is liable within the scope of the statutory provisions. Otherwise, Lystero's liability is, to the extent permitted by law, limited to intent and gross negligence; liability for slight negligence is excluded. Liability for intent and gross negligence cannot be contractually excluded (Art. 100 CO).
Lystero does not warrant the uninterrupted availability of the Platform.
Personal data is processed in accordance with the Swiss Federal Act on Data Protection (revDSG) and, where applicable, the GDPR. Details are set out in the privacy policy, which forms an integral part of these GTC.
The User may delete their account at any time. Lystero may terminate the usage relationship with immediate effect in the event of breaches of these GTC or applicable law. Ongoing Safe Pay transactions are properly completed before an account is deleted.
Lystero may amend these GTC, for instance in the event of a changed legal situation or new features. Amendments are communicated to Users in a suitable manner. If the User does not object within the communicated period and continues to use the Platform, the amended GTC are deemed accepted.
Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and conflict-of-law rules.
The exclusive place of jurisdiction is Zurich, Switzerland, unless mandatory statutory places of jurisdiction (in particular for consumers) provide otherwise.
Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by a rule that comes closest to its economic purpose.
